Es wird der Versuch unternommen, die österreichische Strafrechtsreform ähnlich wie sozialpolitische und Bildungs-Reformen als Staatstätigkeit zu analysieren. Hierbei wird am Beispiel der Beziehung zwischen ideologischem Gewand und Inhalt der Strafrechtsreform vor allem die Interaktion zwischen der Form staatlichen Handelns (parlamentarisch-demokratisches System; formale Sicherung von Freiheit, Gleichheit, Humanität etc.) und dessen Funktion (Überwindung von den in der gesellschaftlich verfügbaren Arbeitskraft liegenden Schranken der Kapitalverwertung; Sicherung der Reproduktion intensivierter Arbeit) berücksichtigt. |

Reforms in the field of criminal law are analysed in terms of their potential to resolve contradictions between a changed economic situation (after the period of reconstruction after WW II) and the criminal code, as well as their potential to legitimize the democratic state and its capacity to cope with such contradictions. The relevant aspects of the economy are described as the change from extensive to intensive use of labour and intensification of markets. The concomitant criminal-law reforms correspond to these processes of intensification by certain de-criminalizations as well as a polarization in the severity of application of the law. |
